Texas sues OpenAI, seeks court check before new AI models
Why it matters
Texas Attorney General Ken Paxton sued OpenAI and CEO Sam Altman on Oct 23, 2026 (Collin County; Texas Deceptive Trade Practices Act and SCOPE Act claims), alleging OpenAI marketed ChatGPT as safe and reliable while failing to protect Texans, including children. The petition asks the court to bar OpenAI from releasing any new AI model to Texas users unless an independent third-party evaluator, approved by the court, reviews its safety guardrails and approves the release; to stop OpenAI offering ChatGPT to minors in Texas; and to order civil penalties of $10,000 per violation. OpenAI said (statement quoted by The Hill) it has worked with experts to improve ChatGPT, mitigate risks and build safeguards, and supports AI policies that apply to the entire industry, "not just one company." These are allegations; no court has ruled.
